After Settlement They Keep Calling

I settled a lawsuit with a common debt collector about a year and a half ago. I had not heard a peep out of them after the suit. As it should be, they have not contacted me. I cashed the settlement check and went on with my life.

Until two weeks ago.

The debt collector started calling me again. How stupid can you be? You wrote me a check to go away, then you come back? I guess they must not be out of checks yet. I also guess they are not out of money yet either.

This bodes well for me. It is like seeing the collectors ugly twin ready to give me more money.

The collector has called my cell phone 10 times in the last two weeks. They are using automated equipment. They do not have my permission to call.

When I was thinking through my new second lawsuit with the collector, I was unsure if I had given them my cell number during negotiations. If I did give them my cell number to negotiate, I would have argued that was not for collections. I am not sure how that would have played out.

As I thought more and more about this, I realized I had changed my cell phone number since the first lawsuit and there wont be an issue.

Now I have to decide how long to let them continue before I sue them. If they keep calling, they are ringing up more statutory damages. I have other cases to work on so I am going to wait to engage them.

Just wanted to share with you what was going on in my slice of the world. As you know I don’t always post regularly but am still here fighting the fight. I think I will be fighting this for the rest of my life.

  1. How about getting them 2 or 3 times. File now, settle. Wait for them to start again, File, Settle. Rinse and repeat?

      I think your strategy will work for you if they continue to call you after your first settlement. They should stop after settlement, but never underestimate how stupid they are. “Stupid” is the only term I can think that adequately describes them after watching debt collectors closely for years.

      This is currently happening to me with Midland Funding. I am waiting to go after them for a second time. They have been calling my cell. I guess they weren’t satisfied with writing me only one check.

      The reason that I haven’t already filed with them is that other collectors have take priority. I have a couple of issues in line ahead of Midland.
