Here is my answer to credit card lawsuits. sample answer
The first section that most people would call the header is called the styling. This section must be changed to conform with your court’s rules. You can get a good idea what the styling should look like by looking at the complaint that was filed against you. Also, your court should have local rules that describe the styling and also the proper font and margins. My experience is that they are not too picky with this as long as it is close.
When answering a lawsuit, I give only three possible answers:
- Agreed – I only agree with basic information: my name, my address, my employer, etc.
- Denied – I deny almost everything: Balance is…. DENIED. Account opened on… DENIED. You get the idea. Anything that I am not 100% sure of, I deny. I don’t remember dates and numbers so they are always denied.
- Without Knowledge – Things I could not know: Bank sold account to collector on May 27, 2012… Without Knowledge. Collector called Defendant and there was no answer… Without Knowledge.
I never give anything other than those three replies. Why would you give them more information? The answer will not get your case dismissed, that is a Motion. Don’t put your cards on the table with an Answer. Show your cards in a Motion.
