Who can you add to a FDCPA lawsuit?

All,

I get many questions about who can be added to a FDCPA lawsuit. You will want to add as many as you can if you want to add to the statutory damages.

In general, I add everyone that is a lawyer, owner, manager of a company or law-firm. I also add the company and law-firm as well. Also parent companies.

For example, Midland funding is on my credit report. They never returned my letters or respond to my demands. I have never talked to anyone there. So I sued them and their parent companies:

Midland Funding, Midland Credit Management and Encore are all defendants.

Lets take another example. I received collection letters from an agency in California. Lets call them Smith and Jones. When I sent them a debt validation letter, their corporate attorney responded with the normal nonsense that lawyers are known to send. Who did I sue?

Smith and Jones law-firm, Smith individually, Jones individually and the nonsense lawyer.

Here is a great article about this from Temple Law Review

    • Good Point Valerie!
This point you make about statute of limitations (SOL) is also key to prioritizing your issues. File your lawsuits that are closest to the SOL first!
