There are more laws than just the FDCPA, FCRA and TCPA that debt collectors routinely violate. Of course most sates have similar laws that the collectors violate routinely as well.
Now, the Department of Justice has agreed to a settlement with Peroutka and Peroutka P.A., a dirt bag collection agency out of Maryland. There address is:
Peroutka & Peroutka, P.A. | 8028 Ritchie Highway, Suite 300 | Pasadena, MD 21122-1360
888-768-2280-233
The settlement relates to their violations of the Americans with Disables Act (ADA) as they were discriminating against a deaf American. The settlement was reported to be $30,000.
Peroutka and Peroutka P.A. violated the ADA by refusing to accept Video Relay Service calls, which were necessary for the deaf to communicate by phone with Peroutka employees.
Title III of the ADA prohibits discrimination against people with disabilities at places of public accommodation, including law firms. Among other things, Title III requires public accommodations to afford people with disabilities full and equal enjoyment of their goods, services, and facilities. The ADA also requires public accommodations to make reasonable modifications to their policies, practices, and procedures when necessary to afford equal access to people with disabilities, unless doing so would fundamentally alter the goods or services provided.
“People with disabilities cannot be denied services simply because they use alternative ways to communicate,” said Assistant Attorney General Thomas E. Perez. “The ADA does not tolerate this type of discrimination and neither does the Justice Department.” (Source: DOJ)
Oddly enough, The Better Business Bureau has them rated an A+. How can that be?
If you are having problems with Peroutka and Peroutka P.A., in addition to taking them to task for any FDCPA, FCRA or TCPA violations; you may want to file a complaint with the The Better Business Bureau.
